Participation in Memorial Park Conservancy (“MPC”) programs requires acknowledgment of the following waiver and liability release.
MPC hosts a variety of programs, events, and activities throughout Memorial Park, including but not limited to fitness and wellness classes, recreational activities, educational programming, cultural or musical events, volunteer opportunities, and other community gatherings. Programs may be hosted, organized, or facilitated by MPC and may involve guest instructors, contractors, vendors, or program partners.
Memorial Park is a natural outdoor environment, and participation in or attendance at park programs may involve physical activity and outdoor conditions. Participants and attendees may encounter uneven terrain, weather conditions, wildlife, equipment use, crowds, and other environmental or site-related factors, including the actions of other participants or park visitors. As with any recreational or outdoor activity, participation involves inherent risks that may result in injury, illness, death, property damage, or other harm.
By registering for or participating in an MPC program or event, participants acknowledge and agree to the following:
Assumption of Risk
Participants and attendees understand the nature of the activity and voluntarily assume all risks associated with participation in or attendance at MPC programs, events, and activities.
Health & Personal Responsibility
Participants are responsible for determining whether they are physically able to participate in program activities and agree to participate responsibly and in accordance with any guidance or instructions provided by MPC staff, volunteers, instructors, contractors, vendors, program partners, or event personnel.
Volunteer Activities
Individuals participating in volunteer activities acknowledge that such activities may involve additional physical demands and risks, including but not limited to the use of tools or equipment, lifting, exposure to environmental conditions, and other conservation, maintenance, or event support tasks. Volunteers agree to follow all instructions, safety protocols, and supervision provided by MPC staff and understand that they are participating in a voluntary, unpaid capacity and are not employees of MPC or entitled to compensation, wages, or employee benefits.
Release of Liability
To the fullest extent permitted by law, participants agree to RELEASE, WAIVE, AND HOLD HARMLESS Memorial Park Conservancy, including its employees, volunteers, instructors, contractors, vendors, representatives, and program partners, from any and all claims, demands, liabilities, damages, or expenses arising out of or related to participation in or attendance at MPC programs or events, INCLUDING CLAIMS ARISING FROM THE ORDINARY NEGLIGENCE OF MEMORIAL PARK CONSERVANCY, except in cases of gross negligence or willful misconduct.
Indemnification
Participants further agree to indemnify and hold harmless MPCyfrom any claims, damages, or expenses arising from their participation in the activity or from their failure to follow applicable rules, instructions, or safety guidance.
Emergency Medical Care
Participants understand that, in the event of an injury or medical emergency during participation, emergency services may be contacted if deemed necessary. Participants are responsible for any medical costs that may be incurred as a result of their participation.
Alcohol Acknowledgement
Certain events hosted or facilitated by MPC may involve the service or consumption of alcoholic beverages where permitted by law. Participants acknowledge that alcohol consumption may increase risks associated with participation and agree to consume alcohol responsibly and in accordance with all applicable laws and event guidelines.
Media Release
Participants acknowledge that photographs, video recordings, or other media may be captured during programs or events in Memorial Park. By participating or attending, individuals grant MPC permission to use such images or recordings for promotional, marketing, educational, or other lawful purposes without compensation.
Participant Conduct
Participants agree to follow all applicable park rules and program guidelines. MPC reserves the right to refuse participation in or remove individuals from a program or event if their behavior is deemed unsafe, disruptive, unlawful, or inconsistent with the safe and respectful use of Memorial Park.
Program Changes & Weather
Programs and events may be modified, rescheduled, relocated, or canceled due to weather conditions, safety considerations, park operations, or other circumstances beyond MPC’s control.
Minor Participation
A parent or legal guardian registering a minor for participation in an MPC program or event acknowledges responsibility for the minor’s participation and agrees to the terms of this waiver on the minor’s behalf.
Personal Property
MPC is not responsible for lost, stolen, or damaged personal property brought to programs or events.
Severability
If any portion of this waiver is determined to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
